With property prices seemingly on the rise and rising quickly in Tampa, there is a lot of talk about a real estate bubble in the US and dire predictions that the so-called bubble could burst, leading to a lack of confidence on the part of investors and people seeking a second home. But while this talk of a bubble may be true in some parts of America, it isn’t justified in Florida, particularly in the Tampa Bay and Clearwater areas.

Florida as a whole is enjoying a rise in property prices which promises to be a long term trend. There are many reasons for this.

Demand for real estate in Florida is increasing. Homes are being bought for various reasons. Both American and European holiday makers view Florida as a premier summer holiday location and flock there each summer and historical evidence suggests that this figure is rising sharply and is having a major economic impact on the region according to VISIT FLORIDA research.

This growth in visitors is due to Florida’s many attractions, many of which are near to Tampa Bay. The superb beaches, the night life opportunities, golf and other sporting opportunities whether playing or being a spectator, the theme parks and adventure worlds, Disney, of course – and the many areas of unspoiled beauty. And, if anything, this annual visitation is set to increase again as the Super Bowl comes to Tampa in 2009. This will be the fourth Super Bowl to be held in Tampa. This has a dramatic effect on our area’s prosperity.

The increasing economic prosperity also makes Florida in general and Tampa Bay in particular a good place to find a job or start a business. In 2004, Florida was ranked #2 as one of the best places in America for start-ups. More and more companies are also relocating their headquarters to Tampa, as well. Tampa is now being called the “Gateway to the Florida High Tech Corridor”, because companies are being offered a matching grant program that has generated more than $120 million in applied research. 225 companies have already taken advantage of this.

The area has relatively low real estate prices and a lower cost of living and higher employment statistics compared to the rest of Florida and to other states in America, despite recent increases. The median value for a home in Florida was $189,500 last year, significantly less than similar homes in California where the median home value was $474,370. Florida, including Tampa, also enjoys the advantage of having slightly more favorable property taxes compared with other parts of the US, no state income tax and better car insurance rates. The education system has undergone considerable improvement over the past number of years. And the Tampa area also has some of the best commute to work times in the country.

Tampa Bay is perhaps the ideal place not just for the baby boomer buying a second house or holiday home, nor just for the property investor seeking to increase their footprint in the holiday rental market, but also for people starting out in life or those seeking a retirement home.

There have been several new developments in Tampa Florida Real Estate and Clearwater Real Estate holdings; the plans for developing downtown Tampa, especially the Rivergate area, are potentially very exciting indeed, according to recent articles in the Tampa Bay Business Journal.

In short, Florida as an area for either relocation, investment or a second home is currently one of the most attractive in America and likely to remain so for some time. The drivers of the state of Florida right now are so confused and rightfully so. There has been a bitter fight, insurance company and insurance company vs. insurance company and medical professionals vs. medical professionals and Lawyers vs. Lawyer and insurance company… and verses and verses. All this, while the poor driving public of Florida is caught in the middle and is helpless and most clueless of what is happening.

To start lets find out just what the heck is PIP.

The Basics

First states are generally broken up into two categories, Tort States and PIP States. If you live in a Tort state things are a bit less complicated and easier to understand. In a nutshell if you are in a car accident and you are “At Fault” then you are responsible for the injuries of others. You will be sued for all, injuries to the other drivers, passengers and any property damage that you caused.

In a tort state it is absolutely necessary that you have liability insurance to pay for such damages and most states have a requirement of minimum liability such as 25/50/25. To translate that is $25,000 for Bodily Injury you do to one person in and accident, $50,000 Total per accident for Bodily Injury and $25,000 for Property Damage.

PIP States, out of fifty states at one time there was 38 states that were PIP States, today there are 12 er no, 11 er no effective January 1, when Florida “re-becomes” a PIP State 12 again.

What is PIP

Frankly, PIP is a lot more complicated than a tort. Why? First each state employs a different degree of PIP. In order to explain PIP we need to explain “PURE PIP”, which no state employs.

In a “Pure PIP” environment in any accident each person would take care of ALL their own injuries and a law suit against the other party would be prohibited by law. Hence, PIP is also known as “No Fault”. Theoretically each person would buy their own policy to pay for their injuries instead of suing the AT FAULT person. Hmmm, no lawsuits, you can imagine how attorneys would feel about that. That is just one drawback; the second is how much coverage each person should have under a “PURE PIP” environment. Because of this the remaining handful of PIP states have varying degrees of PIP.

Florida PIP

In 1971 Florida legislators passed the PIP law and no longer was it mandatory to secure liability insurance but at that time only one coverage was necessary to register your vehicle. PIP.

The Florida version of PIP every citizen of the state of Florida would buy this coverage and have a “bag of money” of $10,000 to take care of themselves for injuries resulting from “any” auto accident. Your coverage will pay no matter who was at fault.

The problems with this law were immediate. First it contradicted the Florida responsibility law which in short states that when a driver is involved in an accident that involves bodily injury or property damages to an extent that an auto is disabled you must prove you have liability limits of 10/20/10 or $30,000 of combined liability.

The second problem was the law did not address any “Property Damage” done by the at fault driver. That was remedied a few years after with the addition of $10,000 of mandatory property damage liability being added to the requirements to register your car.

Another problem was that of “Tort Immunity” or “Tort Exemption”. The problem, no one really understood it.

Tort What?

“Tort Immunity” also known as “Tort Exemption” is what PIP is all about. If you recall under “PURE PIP” you may not sue the at fault party, that is Tort Immunity. As we also mentioned each state has varying degrees of PIP and also varying degrees of “Tort Immunity” In order vary the tort immunity each state must define the limit of the immunity. States have either a Financial “Threshold” or Verbal “Threshold”. For example a person may not sue the other at fault person until their medical bills exceed $50,000, this would be a example of a Financial or Dollar Threshold.

Florida has a “Verbal Threshold” although each person is responsible for the first $10,000 of their own injuries regardless who is at fault, you can sue the “At Fault” driver for any economic damages you incur over the first $10,000 but, you will NOT be able to sue for any “non economic” injuries (such as Pain and Suffering) unless you “pierce” a threshold and this is Florida’s extent of “Tort Immunity”

What were the problems with PIP?

The spirit of PIP was quite noble, instead of suing everyone for small accidents the PIP coverage would cover “most” medical expenses, loss of work and even some household chores you were not able to do because of the accident. Thus there would be a reduction in lawsuits.

Well, although noble the law almost immediately added an new level of litigation and/or negotiation, that is determining whether a threshold had been crossed. The Florida verbal thresholds are : 1. Loss of a bodily function 2. Permanent injury 3. “Significant” scaring and 4. Death.

Death is the easiest threshold to determine, if a person is still breathing then obviously the threshold has not been crossed and the person can not sue for “non economic” injuries such as pain and suffering. But the other thresholds such as: Significant scaring may be harder to interpret. So much having fewer lawsuits.

I want you to think of the last time you were driving and drove by an auto accident. How many folks did you see in each car or van? At least 2, 6, 10 ? What ever the number multiply that number by $10,000.

The problem became “Fraud”. No matter how little the injury unethical medical practitioners bilked the companies. Artificially increased bills paid by insurance were ultimately passed on to us, insureds.

Florida’s Flip Flop

On October 1, 2007 Florida’s long suffering PIP law was laid to rest with many insurance companies bidding it a happy farewell only to be resurrected a few days latter at the behest of Florida’s governor.

Currently, as of today October 14, 2007 there is no PIP law in effect , no $10,000 bag of money to cover your medical expenses, no tort immunity actually not much of any kind of mandatory coverage until January 1, 2008 when PIP will be reinstated.

Many companies had scrambled to add a “Non Statutory” PIP to give everyone $10,000 benefits and we recommend at least that with at least $2,000 of Medical Payments and uninsured motorist.

Now would be a good time to contact your agent and review your coverages.

How far are Tampa, Clearwater, and Bradenton from St. Petersburg, Florida?

Hi,

I'm going to move soon in St. Petersburg, Florida, and I'd like to know how long does it take to drive from St. Petersburg to Tampa, Clearwater, and Bradenton.

I'd like to know this to make sure the commute between these cities wouldn't take too long. Is there a lot of traffic between these cities?

Do you think it's easy to live in St. Petersburg and work in Tampa? or is it too far?

The drivers of the state of Florida right now are so confused and rightfully so. There has been a bitter fight, insurance company and insurance company vs. insurance company and medical professionals vs. medical professionals and Lawyers vs. Lawyer and insurance company… and verses and verses. All this, while the poor driving public of Florida is caught in the middle and is helpless and most clueless of what is happening.

To start lets find out just what the heck is PIP.

The Basics

First states are generally broken up into two categories, Tort States and PIP States. If you live in a Tort state things are a bit less complicated and easier to understand. In a nutshell if you are in a car accident and you are “At Fault” then you are responsible for the injuries of others. You will be sued for all, injuries to the other drivers, passengers and any property damage that you caused.

In a tort state it is absolutely necessary that you have liability insurance to pay for such damages and most states have a requirement of minimum liability such as 25/50/25. To translate that is $25,000 for Bodily Injury you do to one person in and accident, $50,000 Total per accident for Bodily Injury and $25,000 for Property Damage.

PIP States, out of fifty states at one time there was 38 states that were PIP States, today there are 12 er no, 11 er no effective January 1, when Florida “re-becomes” a PIP State 12 again.

What is PIP

Frankly, PIP is a lot more complicated than a tort. Why? First each state employs a different degree of PIP. In order to explain PIP we need to explain “PURE PIP”, which no state employs.

In a “Pure PIP” environment in any accident each person would take care of ALL their own injuries and a law suit against the other party would be prohibited by law. Hence, PIP is also known as “No Fault”. Theoretically each person would buy their own policy to pay for their injuries instead of suing the AT FAULT person. Hmmm, no lawsuits, you can imagine how attorneys would feel about that. That is just one drawback; the second is how much coverage each person should have under a “PURE PIP” environment. Because of this the remaining handful of PIP states have varying degrees of PIP.

Florida PIP

In 1971 Florida legislators passed the PIP law and no longer was it mandatory to secure liability insurance but at that time only one coverage was necessary to register your vehicle. PIP.

The Florida version of PIP every citizen of the state of Florida would buy this coverage and have a “bag of money” of $10,000 to take care of themselves for injuries resulting from “any” auto accident. Your coverage will pay no matter who was at fault.

The problems with this law were immediate. First it contradicted the Florida responsibility law which in short states that when a driver is involved in an accident that involves bodily injury or property damages to an extent that an auto is disabled you must prove you have liability limits of 10/20/10 or $30,000 of combined liability.

The second problem was the law did not address any “Property Damage” done by the at fault driver. That was remedied a few years after with the addition of $10,000 of mandatory property damage liability being added to the requirements to register your car.

Another problem was that of “Tort Immunity” or “Tort Exemption”. The problem, no one really understood it.

Tort What?

“Tort Immunity” also known as “Tort Exemption” is what PIP is all about. If you recall under “PURE PIP” you may not sue the at fault party, that is Tort Immunity. As we also mentioned each state has varying degrees of PIP and also varying degrees of “Tort Immunity” In order vary the tort immunity each state must define the limit of the immunity. States have either a Financial “Threshold” or Verbal “Threshold”. For example a person may not sue the other at fault person until their medical bills exceed $50,000, this would be a example of a Financial or Dollar Threshold.

Florida has a “Verbal Threshold” although each person is responsible for the first $10,000 of their own injuries regardless who is at fault, you can sue the “At Fault” driver for any economic damages you incur over the first $10,000 but, you will NOT be able to sue for any “non economic” injuries (such as Pain and Suffering) unless you “pierce” a threshold and this is Florida’s extent of “Tort Immunity”

What were the problems with PIP?

The spirit of PIP was quite noble, instead of suing everyone for small accidents the PIP coverage would cover “most” medical expenses, loss of work and even some household chores you were not able to do because of the accident. Thus there would be a reduction in lawsuits.

Well, although noble the law almost immediately added an new level of litigation and/or negotiation, that is determining whether a threshold had been crossed. The Florida verbal thresholds are : 1. Loss of a bodily function 2. Permanent injury 3. “Significant” scaring and 4. Death.

Death is the easiest threshold to determine, if a person is still breathing then obviously the threshold has not been crossed and the person can not sue for “non economic” injuries such as pain and suffering. But the other thresholds such as: Significant scaring may be harder to interpret. So much having fewer lawsuits.

I want you to think of the last time you were driving and drove by an auto accident. How many folks did you see in each car or van? At least 2, 6, 10 ? What ever the number multiply that number by $10,000.

The problem became “Fraud”. No matter how little the injury unethical medical practitioners bilked the companies. Artificially increased bills paid by insurance were ultimately passed on to us, insureds.

Florida’s Flip Flop

On October 1, 2007 Florida’s long suffering PIP law was laid to rest with many insurance companies bidding it a happy farewell only to be resurrected a few days latter at the behest of Florida’s governor.

Currently, as of today October 14, 2007 there is no PIP law in effect , no $10,000 bag of money to cover your medical expenses, no tort immunity actually not much of any kind of mandatory coverage until January 1, 2008 when PIP will be reinstated.

Many companies had scrambled to add a “Non Statutory” PIP to give everyone $10,000 benefits and we recommend at least that with at least $2,000 of Medical Payments and uninsured motorist.

Now would be a good time to contact your agent and review your coverages.

In a nutshell if you are in a car accident and you are “At Fault” then you are responsible for the injuries of others. You will be sued for all, injuries to the other drivers, passengers and any property damage that you caused.

In a tort state it is absolutely necessary that you have liability insurance to pay for such damages and most states have a requirement of minimum liability such as 25/50/25. To translate that is $25,000 for Bodily Injury you do to one person in and accident, $50,000 Total per accident for Bodily Injury and $25,000 for Property Damage.

PIP States, out of fifty states at one time there was 38 states that were PIP States, today there are 12 er no, 11 er no effective January 1, when Florida “re-becomes” a PIP State 12 again.

What is PIP

Frankly, PIP is a lot more complicated than a tort. Why? First each state employs a different degree of PIP. In order to explain PIP we need to explain “PURE PIP”, which no state employs.

In a “Pure PIP” environment in any accident each person would take care of ALL their own injuries and a law suit against the other party would be prohibited by law. Hence, PIP is also known as “No Fault”. Theoretically each person would buy their own policy to pay for their injuries instead of suing the AT FAULT person. Hmmm, no lawsuits, you can imagine how attorneys would feel about that. That is just one drawback; the second is how much coverage each person should have under a “PURE PIP” environment. Because of this the remaining handful of PIP states have varying degrees of PIP.

Florida PIP

In 1971 Florida legislators passed the PIP law and no longer was it mandatory to secure liability insurance but at that time only one coverage was necessary to register your vehicle. PIP.

The Florida version of PIP every citizen of the state of Florida would buy this coverage and have a “bag of money” of $10,000 to take care of themselves for injuries resulting from “any” auto accident. Your coverage will pay no matter who was at fault.

The problems with this law were immediate. First it contradicted the Florida responsibility law which in short states that when a driver is involved in an accident that involves bodily injury or property damages to an extent that an auto is disabled you must prove you have liability limits of 10/20/10 or $30,000 of combined liability.

The second problem was the law did not address any “Property Damage” done by the at fault driver. That was remedied a few years after with the addition of $10,000 of mandatory property damage liability being added to the requirements to register your car.

Another problem was that of “Tort Immunity” or “Tort Exemption”. The problem, no one really understood it.

Tort What?

“Tort Immunity” also known as “Tort Exemption” is what PIP is all about. If you recall under “PURE PIP” you may not sue the at fault party, that is Tort Immunity. As we also mentioned each state has varying degrees of PIP and also varying degrees of “Tort Immunity” In order vary the tort immunity each state must define the limit of the immunity. States have either a Financial “Threshold” or Verbal “Threshold”. For example a person may not sue the other at fault person until their medical bills exceed $50,000, this would be a example of a Financial or Dollar Threshold.

Florida has a “Verbal Threshold” although each person is responsible for the first $10,000 of their own injuries regardless who is at fault, you can sue the “At Fault” driver for any economic damages you incur over the first $10,000 but, you will NOT be able to sue for any “non economic” injuries (such as Pain and Suffering) unless you “pierce” a threshold and this is Florida’s extent of “Tort Immunity”

What were the problems with PIP?

The spirit of PIP was quite noble, instead of suing everyone for small accidents the PIP coverage would cover “most” medical expenses, loss of work and even some household chores you were not able to do because of the accident. Thus there would be a reduction in lawsuits.

Well, although noble the law almost immediately added an new level of litigation and/or negotiation, that is determining whether a threshold had been crossed. The Florida verbal thresholds are : 1. Loss of a bodily function 2. Permanent injury 3. “Significant” scaring and 4. Death.

Death is the easiest threshold to determine, if a person is still breathing then obviously the threshold has not been crossed and the person can not sue for “non economic” injuries such as pain and suffering. But the other thresholds such as: Significant scaring may be harder to interpret. So much having fewer lawsuits.

I want you to think of the last time you were driving and drove by an auto accident. How many folks did you see in each car or van? At least 2, 6, 10 ? What ever the number multiply that number by $10,000.

The problem became “Fraud”. No matter how little the injury unethical medical practitioners bilked the companies. Artificially increased bills paid by insurance were ultimately passed on to us, insureds.

Florida’s Flip Flop

On October 1, 2007 Florida’s long suffering PIP law was laid to rest with many insurance companies bidding it a happy farewell only to be resurrected a few days latter at the behest of Florida’s governor.

Currently, as of today October 14, 2007 there is no PIP law in effect , no $10,000 bag of money to cover your medical expenses, no tort immunity actually not much of any kind of mandatory coverage until January 1, 2008 when PIP will be reinstated.

Many companies had scrambled to add a “Non Statutory” PIP to give everyone $10,000 benefits and we recommend at least that with at least $2,000 of Medical Payments and uninsured motorist.

Now would be a good time to contact your agent and review your coverages.

Well 2 nights ago I hit a deer on the way home causing moderate front end damage to the car. How “illegal” would it be if I were to add comprehensive insurance to my policy, then wait a few days and make a claim?

Florida is famous for rendezvous’s like Daytona Bike Week in the Spring, Biketober Fest and the West Coast Biker Rally in the fall. Attracting hundreds of thousands of motorcyclist yearly, many of these riders are not your hardcore bikers, they are likely to be family oriented people who share a passion for the wind.

July 1, 2000 Florida’s helmet law was changed. While not completely repealed it was modified with an amendment that stipulates certain requirements for bikers that want to ride helmet-less in Florida. The law states “You do not have to wear a helmet in Florida if you are at least 21 years old and have a minimum $10,000 in medical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle”.

Taking away the right to make this personal choices is not the answer. Organizations like ABATE (”A Brotherhood Against Totalitarian Enactments”) and the AMA (”American Motorcyclist Association”) fight hard for the rights of the motorcyclist. The most important thing they do is rally together and force lawmakers to listen. Many organizations have pushed to change the law for various reasons. Are they trying to change it for personal regard for the rider? While many feel as though their rights are being taken away the reality is most motorcyclist do not carry enough personal protection insurance to cover them in the event they go down. The bottom line is the cost to treat injured motorcyclists with head injuries as the primary diagnosis is staggering.

A summary was compiled by the NHTSA (National Highway Traffic Safety Association) and released in 2005. The effects of Florida’s repeal of its all-rider motorcycle helmet use law are similar to those seen in the other states that have repealed such laws (Arkansas, Kentucky, Louisiana, Texas). These statics were found at head-trauma-resource.com.

* Deaths increased by 24 percent above what was expected from the increase in motorcycle registrations.

* Helmet use declined from near 100 percent to near 50 percent after the all-rider helmet law was repealed.

* The decline in helmet use likely contributed to the increase in fatalities.

* Deaths in riders 21 years, who were still required to wear helmets, increased by 188 percent.

* Motorcycle fatalities and fatality rates rose in Florida much more than nationally.

* Costs to treat injured motorcyclists with head injury as primary diagnosis more than doubled – to $44 million in 2002.

* Fewer than 25 percent of the hospitalized cases for head, brain or skull injuries cost less than $10,000, the required level of insurance to ride without a helmet.

* One out of five hospital-admitted motorcyclists had costs (total $10.5 million) billed to charitable and public sources (e.g. Medicaid).

When other motor vehicle laws are changed the ball starts rolling. Florida changed the seat belt law beginning June 30, 2009. Under the new law, Florida drivers can be pulled over for failing to wear a seat belt and fined $30.00. This is a primary enforcement law, which means the driver need not be doing anything else wrong to warrant a stop.

Information found at knowledgebase.findlaw.com states the NHTSA estimates that Florida can expect to save 124 lives per year with the new law. More than 1,700 people will be spared serious injuries and costs will be reduced more than $408 million. The NHTSA estimates that Florida could save 184 lives, prevent more than 2,500 serious injuries and save an additional $605 million annually if seatbelt use increased to 90 percent. Their figures show that seatbelt use saved 857 lives in Florida in 2007 and $3.8 billion in costs.

How long will it take before “Big Brothers” eyes again will be turned toward the biker. If you listen to the news when reporting a motorcycle accident it is nearly always mentions if the rider was NOT wearing a helmet.

If taking away a bikers right to wear or not to wear a helmet is due to liability insurance, why not address that part of the law? Hopefully before a group lobbies to take away this hard fought right a simple solution will be found.

The drivers of the state of Florida right now are so confused and rightfully so. There has been a bitter fight, insurance company and insurance company vs. insurance company and medical professionals vs. medical professionals and Lawyers vs. Lawyer and insurance company… and verses and verses. All this, while the poor driving public of Florida is caught in the middle and is helpless and most clueless of what is happening.

The drivers of the state of Florida right now are so confused and rightfully so. There has been a bitter fight, insurance company and insurance company vs. insurance company and medical professionals vs. medical professionals and Lawyers vs. Lawyer and insurance company… and verses and verses. All this, while the poor driving public of Florida is caught in the middle and is helpless and most clueless of what is happening.

To start lets find out just what the heck is PIP.

The Basics

First states are generally broken up into two categories, Tort States and PIP States. If you live in a Tort state things are a bit less complicated and easier to understand. In a nutshell if you are in a car accident and you are “At Fault” then you are responsible for the injuries of others. You will be sued for all, injuries to the other drivers, passengers and any property damage that you caused.

In a tort state it is absolutely necessary that you have liability insurance to pay for such damages and most states have a requirement of minimum liability such as 25/50/25. To translate that is $25,000 for Bodily Injury you do to one person in and accident, $50,000 Total per accident for Bodily Injury and $25,000 for Property Damage.

PIP States, out of fifty states at one time there was 38 states that were PIP States, today there are 12 er no, 11 er no effective January 1, when Florida “re-becomes” a PIP State 12 again.

What is PIP

Frankly, PIP is a lot more complicated than a tort. Why? First each state employs a different degree of PIP. In order to explain PIP we need to explain “PURE PIP”, which no state employs.

In a “Pure PIP” environment in any accident each person would take care of ALL their own injuries and a law suit against the other party would be prohibited by law. Hence, PIP is also known as “No Fault”. Theoretically each person would buy their own policy to pay for their injuries instead of suing the AT FAULT person. Hmmm, no lawsuits, you can imagine how attorneys would feel about that. That is just one drawback; the second is how much coverage each person should have under a “PURE PIP” environment. Because of this the remaining handful of PIP states have varying degrees of PIP.

Florida PIP

In 1971 Florida legislators passed the PIP law and no longer was it mandatory to secure liability insurance but at that time only one coverage was necessary to register your vehicle. PIP.

The Florida version of PIP every citizen of the state of Florida would buy this coverage and have a “bag of money” of $10,000 to take care of themselves for injuries resulting from “any” auto accident. Your coverage will pay no matter who was at fault.

The problems with this law were immediate. First it contradicted the Florida responsibility law which in short states that when a driver is involved in an accident that involves bodily injury or property damages to an extent that an auto is disabled you must prove you have liability limits of 10/20/10 or $30,000 of combined liability.

The second problem was the law did not address any “Property Damage” done by the at fault driver. That was remedied a few years after with the addition of $10,000 of mandatory property damage liability being added to the requirements to register your car.

Another problem was that of “Tort Immunity” or “Tort Exemption”. The problem, no one really understood it.

Tort What?

“Tort Immunity” also known as “Tort Exemption” is what PIP is all about. If you recall under “PURE PIP” you may not sue the at fault party, that is Tort Immunity. As we also mentioned each state has varying degrees of PIP and also varying degrees of “Tort Immunity” In order vary the tort immunity each state must define the limit of the immunity. States have either a Financial “Threshold” or Verbal “Threshold”. For example a person may not sue the other at fault person until their medical bills exceed $50,000, this would be a example of a Financial or Dollar Threshold.

Florida has a “Verbal Threshold” although each person is responsible for the first $10,000 of their own injuries regardless who is at fault, you can sue the “At Fault” driver for any economic damages you incur over the first $10,000 but, you will NOT be able to sue for any “non economic” injuries (such as Pain and Suffering) unless you “pierce” a threshold and this is Florida’s extent of “Tort Immunity”

What were the problems with PIP?

The spirit of PIP was quite noble, instead of suing everyone for small accidents the PIP coverage would cover “most” medical expenses, loss of work and even some household chores you were not able to do because of the accident. Thus there would be a reduction in lawsuits.

Well, although noble the law almost immediately added an new level of litigation and/or negotiation, that is determining whether a threshold had been crossed. The Florida verbal thresholds are : 1. Loss of a bodily function 2. Permanent injury 3. “Significant” scaring and 4. Death.

Death is the easiest threshold to determine, if a person is still breathing then obviously the threshold has not been crossed and the person can not sue for “non economic” injuries such as pain and suffering. But the other thresholds such as: Significant scaring may be harder to interpret. So much having fewer lawsuits.

I want you to think of the last time you were driving and drove by an auto accident. How many folks did you see in each car or van? At least 2, 6, 10 ? What ever the number multiply that number by $10,000.

The problem became “Fraud”. No matter how little the injury unethical medical practitioners bilked the companies. Artificially increased bills paid by insurance were ultimately passed on to us, insureds.

Florida’s Flip Flop

On October 1, 2007 Florida’s long suffering PIP law was laid to rest with many insurance companies bidding it a happy farewell only to be resurrected a few days latter at the behest of Florida’s governor.

Currently, as of today October 14, 2007 there is no PIP law in effect , no $10,000 bag of money to cover your medical expenses, no tort immunity actually not much of any kind of mandatory coverage until January 1, 2008 when PIP will be reinstated.

Many companies had scrambled to add a “Non Statutory” PIP to give everyone $10,000 benefits and we recommend at least that with at least $2,000 of Medical Payments and uninsured motorist.
